Different degrees of personal data is held by LCBT dependant on the learner’s interation with the College.
This is split in to three separate privacy policies that work together. These are:

COVID-19 LATERAL FLOW TESTING AT HOME PRIVACY POLICY
OWNERSHIP OF THE PERSONAL DATA
To enable the Covid-19 testing to be completed at The London College of Beauty Therapy, we need to process personal data, including the sharing of personal data where this is allowed under data protection legislation. The London College of Beauty Therapy is the Data Controller for the data required for the management of tests and implementing local arrangements in the event of a positive test.
We will process personal data relating to staff and students under article 6.1(f) of the UK GDPR – it is necessary in the legitimate interest of the data controller. We will process special category personal data under the provisions of article 9.2(i) of the UK GDPR, and Part 1 of Schedule 1(3) of DPA 2018 where it is in the public interest on Public Health Grounds to ensure we can minimise the spread of COVID in a timely manner and enable us to continue to deliver education services as safely and securely as possible. This data is processed under the obligations set out in Public Health legislation (Regulations 3(1) and (4) of the Health Service (Control of Patient Information) Regulations 2002 (COPI)) which allows the sharing of data for COVID related purposes and where it is carried out by a health care professional OR someone who owes an equivalent duty of confidentiality to that data.
Ownership of the Personal Data shared with DHSC
When you do your own testing at home, you must report the results online to the NHS Test & Trace self-reporting website at https://www.gov.uk/report-covid19-result/ and also tell the London College of Beauty Therapy through the following link: LFD Covid-19 Test results. The Department for Health and Social Care (DHSC) is the data controller for the information that you provide to them about you and your test results. For more information about what the DHSC do with your data please see their COVID-19 Privacy Notice
The London College of Beauty Therapy remains the Data Controller for the data we retain about you for the management of tests and implementing local arrangements in the event of a positive test.
You should read both this Privacy Notice and the DHSC COVID-19 Privacy Notice to understand how your personal data is used prior to taking a test.
PERSONAL DATA INVOLVED
The following personal data is processed by the College in relation to your test:
- Name
- Unique code assigned to each individual test and which will become the primary reference number for the tests.
- Test result

Test Kit Log
The following personal data is recorded by the London College of Beauty Therapy in relation to tests you are given to use at home:
First name, last name, telephone number and email address of Test Subject
Details of lot/batch number for the test kits the Test Subject receive
First name, last name of the operator distributing the Home Test Kits
For this Test Kit Log the London College of Beauty Therapy is acting as a ‘processor’ of DHSC and this information will be sent to DHSC. For more information about what DHSC do with your data please see their COVID-19 Privacy Notice
HOW WE STORE YOUR PERSONAL INFORMATION
The primary school / nursery will maintain the test kit log which will only record against your name details of the testing kit which has been provided to you. The London College of Beauty Therapy may also record Personal Data about you in its internal COVID-19 results register (the London College of Beauty Therapy’s COVID-19 results register will not be shared with DHSC). This information will only be stored securely on locally managed systems with appropriate access controls in schools and will only be accessible to personnel involved in the management of tests and implementing local arrangements in the event of a positive test.
The results register will not be shared with any third parties and will be retained for a minimum of 14 days up to a month after the last entries are made by the school into them.
Data from the Test Kit Log may be submitted to DHSC by the The London College of Beauty Therapy on request by DHSC at any time (in the format as notified to the College by DHSC); delete all data contained in the Test Kit Log from the College’s system as soon as instructed to do so by DHSC and in any event, the College shall not keep the data contained in the Test Kit Log for longer than 12 months from the date on which it is collected.

PROCESSING OF PERSONAL DATA RELATING TO POSITIVE TEST RESULTS
We will use this information to enact our own COVID isolation and control processes without telling anyone who it is that has received the positive test.

PROCESSING OF PERSONAL DATA RELATING TO NEGATIVE AND VOID TEST RESULTS
We will record a negative and void result for the purpose of stock controls of tests and general performance of the testing process.
DATA SHARING PARTNERS
The personal data associated with test results will be shared with
- DHSC, NHS, PHE – to ensure that they can undertake the necessary Test and Trace activities and to conduct research and compile statistical information about Coronavirus.
- Your GP – the NHS may share the information you provide with your GP to maintain your medical records and to offer support and guidance as necessary. Any data you provide to the school will not be shared with your GP.
- Local Government to undertake local public health duties and to record and analyse local spreads.
The London College of Beauty Therapy will not share its internal COVID-19 results register with DHSC.
YOUR RIGHTS
Under data protection law, you have rights including:
Your right of access – You have the right to ask us for copies of your personal information.
Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing – You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

OUR USE OF DATA
For purposes of the relevant data protection legislation, London College of Beauty Therapy is the “data controller”.
We will retain any data submit for as long as the company has legitimate interest in the data, for the purpose of analytical reporting as well as informing you of courses requested through your enquiry with LCBT. The only way we can do this is by obtaining your data which is necessary for the performance of a pre-contract of service between the College and the learner under GDPR Article 6(1)(b) “Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.” and GDPR Article 6(1)(f) “Processing is necessary for the purposes of LCBT’s legitimate interests in responding to enquiries from third parties and recording these responses.”
If you go on to enter a contract (e.g. enrolling on to course) then we may hold your personal data for longer – see Student Privacy Policy.
Unless we are obliged or permitted by law to do so, or that there is a legitimate interest or contractual obligation to do so and subject to any third-party disclosures specifically set out in this policy, your data will not be disclosed to third parties. This includes our affiliates and / or other companies within our group.

STUDENT PRIVACY POLICY
This privacy notice explains how The London College of Beauty Therapy (“we”, “our”, “us”) collects, uses and shares your personal data, and your rights in relation to the personal data we hold. This privacy notice concerns our processing of personal data of past, present and prospective students of The London College of Beauty Therapy (“you”, “your”).
The Student Privacy Notice covers all personal data recorded post course enquiry being made by you to the college.
The London College of Beauty Therapy College is the data controller of your personal data and is subject to the current data protection legislation.

We may collect your personal data in a number of ways, for example:
- from the information you provide to us when you interact with us before joining, for example when you express your interest in studying at The London College of Beauty Therapy through the college website, by phone or email;
- when you apply to study at The London College of Beauty Therapy and complete application and enrolment forms and when you complete other admission related processes and procedures;
- when you communicate with us by telephone, email or via our website, for example in order to make enquiries or raise concerns;

THE TYPES OF INFORMATION WE COLLECT

- your name, and contact information such as address, email address and telephone number, as well as your date of birth, national insurance number and your passport number or national identity card details, country of domicile and your nationality. We may also allocate/record or access your unique learner number;
- information relating to your education and employment history, the school(s), sixth form college(s) and other colleges or universities you have attended and places where you have worked, the courses you have completed, dates of study and examination results. We will also keep records relating to assessments of your work, details of examinations taken, your predicted and actual examination grades and other information in your student record;
- information about your family or personal circumstances, and both academic and extracurricular interests, for example where this is relevant to the assessment of your suitability to receive a bursary;
- sensitive personal data and information about criminal convictions and offences for the purpose of safeguarding, including:
- information concerning your health and medical conditions (e.g. disability and dietary needs);
- certain criminal convictions; and
- information about your racial or ethnic origin; religion or similar beliefs; and sexual orientation.
- Not all the above information is collected for all learners and only when required.
How we use information about our students
The purposes for which we may use personal data (including sensitive personal data) we collect during a student’s association with us include:
- recruitment, admissions and enrolment;
- educational matters, including:
- the provision of our core teaching, learning registration, assessment, attendance, managing progress, educational misconduct investigations, certification,);
- maintaining student records;
- assessing your eligibility for bursaries etc.
- providing IT and information services;
- non-educational matters in support of our core services, including:
- providing student support services (e.g. through talkback, Disability and Additional Learning Support, Health and Wellbeing;
- monitoring equal opportunities;
- safeguarding and promoting the welfare of students;
- ensuring students’ safety and security;
- managing the use of social media;
- administering finance (e.g. fees and bursaries);
- other administrative purposes, including:
- carrying out research and statistical analysis;
- carrying out audits (e.g. to ensure compliance with our regulatory and legal obligations);
- providing operational information (e.g. providing IT support, information about building closures or safety advice);
- promoting our services (e.g. providing information about courses, promotions, or other events happening on and off campus);

STUDENT AWARDS
Personal data will be published in the student award booklet. This information will also be passed to third parties involved in the student awards.
The student awards are recorded and will be available to view online afterwards.
THE BASIS FOR PROCESSING YOUR INFORMATION AND HOW WE USE IT
We may process your personal data because it is necessary for the performance of a contract with you or in order to take steps at your request prior to entering into a contract. In this respect, we use your personal data for the following:
- to interact with you before you are enrolled as a student, as part of the admissions process (e.g. to send you a prospectus or answer enquiries about our courses);
- once you have enrolled, to provide you with the services as set out in our College Charter and per our regulatory and legal obligations;
- to deal with any concerns or feedback you may have;
- for any other purpose for which you provide us with your personal data.
We may also process your personal data because it is necessary for the legal performance of our tasks with the ESFA and department of education or because it is necessary for our or a third party’s legitimate interests. In this respect, we may use your personal data for the following:
- to provide you with educational services which may not be set out in our College Charter but which are nevertheless a part of our educational mission;
- to monitor and evaluate the performance and effectiveness of the College, including by training our staff or monitoring their performance;
- to maintain and improve the educational, corporate, financial, services
- to promote equality and diversity throughout the College;
- to seek advice on our rights and obligations, such as where we require our own legal advice;
- recovering money you owe to us;
- for fundraising purposes.

We may also process your personal data for our compliance with our legal obligations. In this respect, we may use your personal data for the following:

- recording on licenced external systems we use to deliver learning, assessment and to carry out our course and qualification obilgations to the learner. Examples consist of e-Portfolio systems, Assessment systems, e-Learning systems and Learner Management Systems.
- current or potential employers (to provide references and, where students are sponsored by their employer and/or where you take part in a placement, to provide details of progress/attendance);
- government departments and agencies where we have an legal obligation to provide information to (e.g. ESFA and Department for Education, Council Tax and relevant local authorities (for the purpose of assessing liability for Council Tax and high needs funding));
- crime prevention or detection agencies (e.g. the police, the Department for Work and Pensions);
- parents, guardians, and next-of-kin (where there is a legitimate reason for disclosure);
- LCBT will store paper records at a secure location usually Abbot Datastore as well as our own premises, for a period than is no longer than needed by our Legal Obligation to do so.
LEAVER DESTINATION SURVEYS
After the completion of your course, we will contact each student to ask them about their destination. Students may also be contacted as part of an audit to check that we have undertaken this survey properly.
CHANGES TO YOUR PERSONAL DATA
Please tell us promptly about any changes to the information we hold about you. This is particularly important for your contact details. You can do this by emailing customer.services@lcbt.co.uk, or in person by completing our change of personal details form.
HOW LONG YOUR INFORMATION IS KEPT
Subject to any other notices that we may provide to you, we may retain your personal data for a period of fourteen years after your association with us has come to an end. However, some information may be retained longer than 14 years, in order to maintain your education record for analytical purposes (or for the purposes of supporting your lifelong relationship with The London College of Beauty Therapy College).

If the London College of Beauty Therapy find the request to be manifestly unfounded or excessive and particularly if it is repetitive then we will charge a ‘reasonable fee’ which will be based on the cost of administration time we feel is needed to respond to the request.
